1. Agreement and eligibility
These Terms form an agreement between you and IT GROUP CORPORATION, the operator of MendezSpeak. By creating an account or using MendezSpeak, you agree to these Terms and our Privacy Policy. You must be at least 18 and legally able to enter this agreement. If you use the service for an organization, you confirm that you are authorized to bind it.
2. Accounts and verification
You must provide accurate information, control the telephone number used for verification, protect your device and credentials, and promptly notify us of unauthorized access. OTP codes are confidential. You are responsible for activity under your account unless applicable law provides otherwise.
We may require additional verification or manual review to protect users, comply with carrier obligations, prevent fraud, or investigate a previously deleted or restricted identity. A deleted account is not automatically reactivated.
3. Voice, translation, and AI
MendezSpeak may use automated speech recognition, translation, synthesis, and AI systems. Results can be delayed, incomplete, or inaccurate, especially with noise, names, accents, specialized terms, or poor connectivity. You must independently confirm important information.
The service is not a substitute for a qualified interpreter or professional medical, legal, financial, governmental, or emergency service. Do not rely on it where an error could cause death, injury, loss of rights, or substantial damage.
4. Calls, telephone numbers, and emergency limitations
MendezSpeak provides internet-enabled calling and may make telephone numbers available through telecommunications providers. Availability, caller ID, routing, coverage, number portability, and supported destinations vary by country, carrier, regulation, and account status.
No emergency calling: MendezSpeak is not a replacement for your mobile or landline telephone and must not be used to contact 911, 112, 999, or another emergency service. Use a conventional emergency-capable phone service.
You do not own assigned telephone numbers. Numbers may be reclaimed after nonpayment, inactivity, termination, regulatory action, carrier action, or failure to provide required information, subject to law. We may block premium-rate, sanctioned, abusive, fraudulent, or unusually risky destinations.
You must obtain all legally required consent before recording a call or including another person’s communications in an AI or translation feature. Recording laws vary by location.
5. Wallet, charges, and refunds
Rates, taxes, telephone-number fees, minimum durations, rounding, and supported currencies are shown before or in connection with the relevant transaction where practical. Calling charges may be deducted from your wallet according to measured or billable usage. Carrier and international rates can change.
MendezSpeak minutes, calling balances, and telephone-number services are telecommunications services. Payment processing may be provided outside Google Play where permitted or required by Google Play’s payments policy and applicable law. We do not sell a wallet balance as a transferable currency; balances cannot be transferred between users or redeemed for cash except where law requires.
Report a billing error or refund request to info@mendezspeak.com within 30 days after the charge. Duplicate, erroneous, or failed transactions will be corrected or refunded after verification. Used calling minutes, completed calls, and telephone-number provisioning or recurring fees are ordinarily non-refundable once delivered because carrier costs are incurred. Unused prepaid balance is refundable only where required by law or expressly approved after deducting non-refundable carrier charges, taxes, chargebacks, and amounts already used. Approved refunds return to the original payment method where practical. These rules do not limit mandatory consumer cancellation, cooling-off, refund, or warranty rights. Chargebacks or suspected payment fraud may result in temporary restriction while reviewed.
6. Acceptable use
You may not use MendezSpeak to violate law or another person’s rights; impersonate, threaten, harass, stalk, or defraud; send spam or unlawful robocalls; manipulate caller ID; evade sanctions or carrier rules; exploit minors; distribute malware; probe or bypass security; reverse engineer where prohibited; overload the service; resell without authorization; or use automation to create accounts, harvest numbers, or generate abusive traffic.
We may apply reasonable usage, destination, rate, and security controls. Suspected abuse can be reviewed by a person.
7. Your content and permissions
You retain rights in content you lawfully provide. You grant MendezSpeak a limited permission to transmit, process, translate, store, and display that content only as needed to operate, secure, support, and improve the requested service, comply with law, and enforce these Terms. You represent that you have the rights and consents needed to provide it.
MendezSpeak and its licensors retain rights in the app, service, branding, software, and documentation. These Terms grant only a limited, revocable, non-transferable right to use the service.
8. Suspension, termination, and account deletion
You may stop using the service and delete your account. Deletion revokes access and deletes or anonymizes ordinary account data, subject to the limited fraud, security, financial, carrier, dispute, and legal retention described in the Privacy Policy.
We may restrict or terminate access when reasonably necessary for security, fraud, abuse, nonpayment, legal compliance, carrier requirements, service protection, or a material breach. Where appropriate and lawful, we will provide notice or a review route.
9. Availability and disclaimers
To the maximum extent allowed by law, the service is provided “as is” and “as available.” We do not guarantee uninterrupted availability, perfect translation, universal connectivity, preservation of every message or recording, a particular telephone number, or compatibility with every carrier or device. Statutory consumer guarantees that cannot lawfully be excluded remain in effect.
10. Limitation of liability
To the maximum extent permitted by law, MendezSpeak is not liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, business, goodwill, or data arising from use of the service. Our aggregate liability for claims relating to the service will not exceed the greater of the amount you paid MendezSpeak during the six months before the event giving rise to the claim or US $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.
11. Changes, law, disputes, and contact
We may update these Terms for legal, security, or service changes. We will post the effective date and provide additional notice where required. Continued use after the effective date means acceptance, unless law requires express consent.
Before filing a formal claim, contact info@mendezspeak.com and allow 30 days for an informal resolution. These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Unless mandatory law permits or requires another forum, claims must be brought in a state or federal court with jurisdiction in Miami-Dade County, Florida. Nothing here removes consumer rights, remedies, or local forums that cannot lawfully be waived in your country or state.
